Training Workshop Terms and Conditions

1. Scope
These terms govern registration for and participation in the training workshops offered by PyPSA Labs gGmbH ("PyPSA Labs"). They apply to both businesses (Unternehmer, § 14 BGB) and consumers (Verbraucher, § 13 BGB); where a rule applies to only one group, this is stated. A registrant is treated as a consumer only where they book and pay in their own name for purposes outside their trade or profession. A booking made in the name of, or paid by, an organisation is a business registration.
2. Registration and contract
Registration is made through the form provided for the respective workshop and constitutes an offer to conclude a participation contract. The contract takes effect once PyPSA Labs confirms the registration in text form (Textform, § 126b BGB), for example by e-mail. Places are limited. If a workshop is full, we may keep a waiting list; a place on it creates no entitlement and no obligation on either side unless and until, subject to the registrant still being interested, we confirm a registration.
3. Prices and discounted rate
Prices are stated per participant on our website and in the registration form. The discounted rate is available to public research organisations, non-profit organisations, and companies established in an economy classified by the World Bank as low-income, lower-middle-income or upper-middle-income, or in a country or territory on the OECD DAC List of ODA Recipients. PyPSA Labs may request reasonable evidence of eligibility; if eligibility is not met or not shown, the regular rate applies.
4. Payment and VAT
All prices are net and in euro; value-added tax is added at the statutory rate resulting from the applicable place-of-supply rules. For business customers established outside Germany, the fee may be invoiced without German VAT where the reverse-charge procedure applies. PyPSA Labs invoices the fee upon confirmation of registration. The fee is payable within 14 days of the invoice date and in any case before the workshop begins. Full payment before the start is a condition of participation.
5. Cancellation by the participant; substitution
Cancellations must be made in text form. The following applies, based on when PyPSA Labs receives the cancellation before the first workshop day:
- more than 30 days before: free of charge;
- 30 to 14 days before: 50 % of the fee;
- fewer than 14 days before, or no-show: 100 % of the fee.
The participant is free to prove that no damage or substantially less damage has been incurred; PyPSA Labs reserves the right to prove higher damage.
Instead of cancelling, the registered participant may be replaced by another named person at any time, including at short notice, at no extra charge. Notice of the substitute's name in text form is sufficient.
For consumers, the statutory right of withdrawal under section 10 remains unaffected and takes precedence where it applies.
6. Cancellation by PyPSA Labs; minimum number of participants
Each workshop requires a minimum of 8 registrations. If this number is not reached, or in the event of force majeure, illness or justified unavailability of the instructors, or comparable reasons beyond our control, PyPSA Labs may cancel the workshop up to 14 days before the first day. PyPSA Labs may also decide, at its discretion, to run a workshop with fewer participants. Fees already paid are refunded in full. Where possible, PyPSA Labs will offer an alternative date. Reimbursement of travel, accommodation or other consequential costs is excluded, except in cases of intent or gross negligence.
7. Course materials and recordings
Workshop materials are made freely available online. Audio or video recording of the sessions by participants is not permitted without the prior consent of PyPSA Labs and the persons concerned.
8. Photographs and data protection
Registration data is processed in accordance with our privacy policy at https://pypsalabs.org/privacy. PyPSA Labs may take photographs during the workshop. Group and overview photographs documenting the event may be published on our website, in reports and in similar communications on the basis of our legitimate interest in documenting our activities (Art. 6(1)(f) GDPR); participants may object at any time, on site, before or afterwards by e-mail to contact@pypsalabs.org, after which we will not use the image concerned going forward. Photographs in which an individual participant is the focus of the image are used for promotional purposes only with that person's separate consent, which may be withdrawn at any time with effect for the future.
9. Conduct
We want our workshops to be a productive and welcoming environment for everyone. PyPSA Labs may exclude a participant from the remainder of a workshop if, despite a prior warning, their conduct seriously and persistently disrupts the event or endangers others. In such a case the fee remains due.
10. Right of withdrawal for consumers (Widerrufsrecht)
This section applies only to consumers.
You have the right to withdraw from this contract within 14 days without giving any reason. The period is 14 days from the day the contract is concluded. To exercise it, inform us (PyPSA Labs gGmbH, Mertensstr. 16A, 13587 Berlin; contact@pypsalabs.org) by a clear statement, for example a letter or e-mail, of your decision to withdraw. Sending the notice before the period expires is sufficient. If you withdraw, we refund all payments received from you without undue delay and within 14 days, using the same means of payment you used, unless expressly agreed otherwise.
If you have expressly requested that we begin the service before the end of the withdrawal period and have confirmed that you are aware that you lose your right of withdrawal upon complete performance of the contract, your right of withdrawal expires once the workshop has been fully carried out. If you withdraw before that point, you owe a proportionate amount for the part already carried out.
11. Liability
For intent and gross negligence (Vorsatz und grobe Fahrlässigkeit), and for injury to life, body or health, PyPSA Labs is liable under the statutory rules. For slight negligence (einfache Fahrlässigkeit), PyPSA Labs is liable only where a material contractual duty (Kardinalpflicht) is breached, and then only for the foreseeable, contract-typical damage. Any further liability is excluded, unless mandatory statutory law provides otherwise.
12. Final provisions
German law applies; for consumers, mandatory protective provisions of their country of habitual residence remain unaffected. Where the participant is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is Berlin. The version of these terms in force at the time of registration applies. Should any provision be or become invalid, the remaining provisions stay in effect.
